Your views on a Public Space Protection Order in Montague Road West Car Park
In recent months, we’ve received growing complaints regarding anti-social behaviour at Montague Road West Car Park which is affecting the quality of life for residents, car park users and visitors. To address these issues and help protect the community, we are proposing the introduction of a Public Space Protection Order (PSPO).
What is a Public Space Protection Order (PSPO)?
A Public Space Protection Order (PSPO), established under Section 59 of the Anti-Social Behaviour, Crime and Policing Act 2014, is designed to address specific nuisances or problems in defined areas that negatively impact the local community’s quality of life by imposing conditions on how those areas are used. This helps ensure people can enjoy public spaces safely and free from anti-social behaviour.
The proposed PSPO for Montague Road West Car Park would set out clear rules and boundaries to address issues such as:
- Littering
- Urination, defecation, deposit of saliva or mucus
- Rough sleeping
- Use of the premises overnight other than for the purpose of parking vehicles
- Obstruction of entrance or exit to or stairwells
- Taking of psychoactive substances (legal highs)
- Congregating or loitering as part of a group of persons in connection with any of the above activities
What this means
A PSPO allows council and other authorised officers to address antisocial behaviour by issuing offenders with a Fixed Penalty Notice, which is a type of fine. You can find more information on who authorised officers are and what the fixed penalty would be under in the FAQ section.
How will the Public Space Protection Order (PSPO) help?
The purpose of the PSPO is to help us:
- Reduce the activities prohibited in the order
- Improve the quality of life for nearby residents, visitors and car park users and make them feel safer
What options were open to the Council?
Do Nothing. This would mean that the council has no powers to address antisocial behaviour in Montague Road West Car Park.
Implement the PSPO. This is our recommendation. We will introduce the PSPO by November 1, 2025, to ensure the council can address the issues in the car park.
Who are we consulting in the borough?
Everyone who lives, works, studies or visits the borough. We also want to hear from local organisations and businesses who support people in the borough.
